Limitation of Liability and Disclaimer of Warranties

1. Software Use and Client Responsibility. The Software is provided on an "as-is" and "as-available" basis. The Client acknowledges and agrees that they are solely responsible for the use of the Software, the configuration of the system, and the accuracy of any data entered into, processed, or generated by the Software.

2. Exclusion of Liability for Erroneous Use. To the maximum extent permitted by applicable law, the Provider shall not be held liable for any direct, indirect, incidental, special, or consequential damages (including, but not limited to, loss of profits, loss of data, business interruption, or commercial loss) arising out of or related to:

• Any erroneous, improper, unauthorized, or non-compliant use of the Software by the Client or its users;
• Any incorrect configuration, lack of training, or human error committed by the Client;
• The introduction of inaccurate, corrupted, or faulty data by the Client.

3. Limitation. The Provider's sole obligation is limited to providing access to the Software in accordance with its standard technical documentation. Under no circumstances shall the Provider's total aggregate liability exceed the amounts actually paid by the Client to the Provider for the subscription during the twelve (12) months preceding the event giving rise to the claim.
